ORDER No. 25\/2004\/L-CTN OF <\/span><\/strong>DECEMBER 14, 2004<\/span><\/strong> ON LAW PROMULGATION <\/span><\/strong><\/span><\/span>THE PRESIDENT OF THE <\/span>SOCIALIST<\/span>REPUBLIC<\/span> OF <\/span>VIETNAM<\/span><\/span><\/span>Pursuant to Articles 103 and 106 of the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51\/2001\/QH10 of December 25, 2001 of the Xth <\/span><\/sup>National Assembly, the 10th <\/span><\/sup>session; <\/span><\/em><\/span><\/span>Pursuant to Article 91 of the Law on Organization of the National Assembly; <\/span><\/em><\/span><\/span>Pursuant to Article 50 of the Law on Promulgation of Legal Documents, <\/span><\/em><\/span><\/span>HEREBY PROMULGATES: <\/span><\/span><\/span>The Law on <\/span>Forest<\/span> Protection and Development, which was passed by the XIth <\/span><\/sup>National Assembly of the Socialist Republic of Vietnam at its 6th <\/span><\/sup>session on <\/span>December 3, 2004<\/span>. <\/span><\/span><\/span>President of the <\/span>Socialist<\/span>Republic<\/span> of <\/span>Vietnam<\/span> TRAN DUC LUONG <\/em><\/span><\/span><\/span>LAW ON <\/span><\/strong>FOREST<\/span><\/strong> PROTECTION AND DEVELOPMENT <\/span><\/strong><\/span><\/span>(No. 29\/2004\/QH11) <\/span><\/em><\/span><\/span>Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51\/2001\/QH10 of December 25, 2001 of the Xth <\/span><\/sup>National Assembly, the 10th <\/span><\/sup>session; <\/span><\/em><\/span><\/span>This Law provides for forest protection and development. <\/span><\/em><\/span><\/span>Chapter I <\/span><\/span><\/span>GENERAL PROVISIONS <\/span><\/span><\/span>Article 1.- <\/span><\/em><\/strong>Regulation scope <\/span><\/span><\/span>This Law provides for the management, protection, development and use of forests (hereinafter referred collectively to as forest protection and development); and forest owners\u2019 rights and obligations. <\/span><\/span><\/span>Article 2.- <\/span><\/em><\/strong>Application subjects <\/span><\/span><\/span>1. This Law applies to State agencies, domestic organizations, households and individuals, overseas Vietnamese as well as foreign organizations and individuals involved in forest protection and development in <\/span>Vietnam<\/span>. <\/span><\/span><\/span>2. In cases where international agreements which the Socialist Republic of Vietnam has signed or acceded to contain provisions different from the provisions of this Law, the provisions of such international agreements shall apply. <\/span><\/span><\/span>Article 3.- <\/span><\/em><\/strong>Term interpretation <\/span><\/span><\/span>In this Law the following terms are construed as follows: <\/span><\/span><\/span><\/p>\n

1. <\/span>Forest<\/span><\/em><\/em>means an ecological system consisting of the populations of forest fauna and flora, forest microorganisms, forestland and other environmental factors, of which timber trees and bamboo of all kinds or typical flora constitute the major components …<\/span><\/span><\/span><\/p>\n
